Privacy Policy

Last Updated: 1 May, 2025

1. Introduction

PhoenixStrategix ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you visit PhoenixStrategix.io (the "Site") or use our coaching services, including bookings through third-party platforms like Paperbell. This policy complies with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) and, where applicable, the General Data Protection Regulation (GDPR) for users in the European Union. By using our Site or services, you consent to the practices described in this policy.

2. Information We Collect

We collect the following types of personal information:

  • Information You Provide: Name, email address, phone number, payment details, and other information you submit via contact forms, booking forms on Paperbell, or during coaching sessions (e.g., testimonials or feedback).
  • Sensitive Information: In limited cases, such as refund requests for exceptional circumstances (e.g., serious illness or bereavement), we may collect sensitive      information like health or personal circumstances, with your explicit consent.
  • Automatically Collected Information: IP address, browser type, device information, and usage data (e.g., pages visited, time spent) collected via cookies or analytics tools like Google Analytics.
  • User-Generated Content: Comments, reviews, or testimonials you submit to the Site, which may include personal information.

If you are under 18, we require parental or guardian consent to collect your personal information, in accordance with APPs and GDPR requirements for minors.

3. How We Use Your Information

We use your personal information for the following purposes:

  • Service Delivery: To process bookings, provide coaching services, and communicate with you about sessions or workshops.
  • Business Operations: To manage payments, respond to inquiries, and process refund requests under Australian Consumer Law or exceptional circumstances.
  • Marketing: To send promotional emails or newsletters about our services, with your consent (you can opt out at anytime).
  • Website Improvement: To analyse Site usage and improve our services using aggregated, anonymised  data.
  • Legal Compliance: To comply with legal obligations under the APPs, GDPR, and other applicable laws.

Under GDPR, our legal bases for processing include your consent, the necessity for performing a contract (e.g., delivering coaching services), and our legitimate interests (e.g., improving the Site), provided these do not override your rights.

4. How We Share Your Information

We may share your personal information with:

  • Third-Party Service Providers: Platforms like Paperbell (for bookings), GoDaddy (for hosting), and payment processors, who process data on our behalf under strict confidentiality agreements.
  • Legal Authorities: If required by law or to protect our rights, safety, or property, or that of others.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to a successor entity, with notice to you.

We do not sell or rent your personal information to third parties for marketing purposes.

5. International Data Transfers

Your personal information may be stored or processed outside Australia, such as by third-party providers like Paperbell or GoDaddy in the United States. We ensure that such transfers comply with APP 8 (cross-border disclosure) and GDPR Article 46, using safeguards like Standard Contractual Clauses or ensuring recipients are in countries with adequate data protection laws. For EU users, we take additional steps to protect your data during international transfers.

6. Data Security

We implement reasonable technical and organisational measures to protect your personal information from unauthorised access, loss, or misuse, including encryption, secure servers, and access controls. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

7. Your Rights

Under the APPs and GDPR, you have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate or incomplete information.
  • Deletion: Request deletion of your information, subject to legal retention obligations.
  • Restriction: Request restriction of processing in certain cases (GDPR).
  • Data Portability: Request a copy of your data in a structured, machine-readable format (GDPR).
  • Objection: Object to processing based on legitimate interests, including direct marketing.
  • Withdraw Consent: Withdraw consent for data processing at any time, without affecting prior lawful processing.

To exercise these rights, contact us at info@phoenixstrategix.io. We will respond within 30 days. If you are unsatisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) or, for EU users, your local data protection authority.

8. Cookies and Tracking

We use cookies and similar technologies to enhance your experience, analyse Site usage, and deliver personalised content. You can manage cookie preferences through your browser settings or our cookie consent tool (for EU users). Essential cookies are required for Site functionality, while non-essential cookies (e.g., analytics) require your consent under GDPR.

9. Data Retention

We retain your personal information only for as long as necessary to fulfil the purposes outlined in this policy, comply with legal obligations, or resolve disputes. For example, booking data may be retained for 7 years to meet Australian tax requirements. After this period, we securely delete or anonymise your information.

10. Minors

Our services are intended for users aged 16 and older. If we collect personal information from users under 18, we require parental or guardian consent. If you believe we have collected data from a minor without consent, please contact us at info@phoenixstrategix.io, and we will take steps to delete it.

11. Third-Party Links

Our Site may link to third-party websites or services, such as Paperbell or GoDaddy. We are not responsible for their privacy practices. We encourage you to review their privacy policies before providing personal information.

12. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify you by posting the updated policy on the Site or via email. Your continued use of the Site or services after such changes constitutes your acceptance of the new policy.
